Overview

Frozen dessert includes:

  • ice cream,
  • frozen custard,
  • French ice cream,
  • French custard ice cream,
  • artificially sweetened ice cream,
  • ice milk,
  • freezer-made shakes,
  • fruit sherbet,
  • water ice,
  • quiescently frozen confection,
  • quiescently frozen dairy confection,
  • manufactured desserts mix,
  • frozen confection,
  • mellorine frozen dessert,
  • or frozen dessert mix.

It also includes any other product similar in appearance, odor, or taste to such products, or that are prepared or frozen as frozen desserts are usually prepared or frozen, whether made with dairy products or non-dairy products.

Wholesale Handler

A wholesale frozen dessert handler is a person who distributes a frozen dessert on a wholesale basis, not directly to the consumer. The forms below are required in order for a wholesale handler to be properly licensed.

In addition, the Department requires a third-party certificate to certify that all frozen dessert products made outside of the United States were manufactured in a facility that meets or exceeds all current and relevant international food sanitary standards.

Wholesale Manufacturer

A wholesale frozen dessert manufacturer is a person who produces, processes, and packages a frozen dessert on a wholesale basis (not directly to the consumer.) The below forms are required in order for a wholesale manufacturer to be properly licensed.

Manufacturing frozen desserts for retail may be subject to inspection by the Division of Food Safety and Inspection

In addition, the Department requires a third-party certificate to certify that all frozen dessert products manufactured outside of the United States were manufactured in a facility that meets or exceeds all current and relevant international food sanitary standards.
